Why do I need a Lasting Power of Attorney?

Without a Lasting Power of Attorney (LPA) in place, your loved ones could face serious challenges if you lose the ability to make decisions for yourself. In such situations, they would need to apply to the Court of Protection to be appointed as your deputy, a process that can be slow, expensive and emotionally draining. You would have no say in who is appointed, and the court ultimately decides who takes control of your finances, healthcare, or living arrangements. In the meantime, jointly held assets like your home or bank accounts may be frozen, putting your spouse or family under unnecessary financial pressure.​

What is an LPA?

There are 2 types of LPA and we usually recommend arranging both at the same time:

Property and Financial Affairs LPA

This allows your appointed Attorney(s) to handle matters such as:

  • Paying bills

  • Managing bank accounts

  • Collecting pensions or benefits

  • Selling or maintaining property

This LPA can be used as soon as it’s registered, with your permission, even if you’re still mentally capable.

Health and Welfare LPA

This covers personal decisions such as:

  • Medical care and treatment

  • Life-sustaining treatment

  • Moving into a care home

  • Daily routines like eating, washing and dressing

This type of LPA can only be used once you’ve lost mental capacity.
